The Ombudsman and Children’s Advocate Act

  • The Children’s Advocate is independent and provides impartial investigations and recommendations
  • The Children's Advocate Office advocates on behalf of children and youth as they are outlined in The Ombudsman and Children’s Advocate Act. (http://www.qp.gov.sk.ca/publications/index.cfm?fuseaction=details&c=1871&id=2)
  • The Children’s Advocate is an appointed officer of the Legislature
  • The Advocate reports to the Legislative Assembly as a whole and not to a particular minister in Cabinet
  • The Board of Internal Economy, an all-party standing committee of the Assembly, reviews the annual budget of the Office

Responsibilities Under the Act

  • The Act identifies that service shall be provided for children up to age 18, as well as youth 18 years of age or older who are receiving services pursuant to the Young Offenders Act or The Young Offenders’ Services Act or section 56 of The Child and Family Services Act
  • The Children’s Advocate has the power to do all things necessary to carry out her responsibilities pursuant to the Act
  • The mandated scope of service and responsibilities are to:
    • Engage in public education respecting the interests and well-being of children.
    • Receive, review and investigate concerns involving services by provincial government departments and agencies to a child or group of children
    • Try to resolve, in appropriate cases, any matter arising between a child, or a group of children and a department or agency of the government in relation to services provided to a child or a group of children by any department or agency of the government
    • Make recommendations with respect to services provided to a child or group of children by any department or agency of government
    • Conduct research to improve the interests and well-being of children
    • Advise any minister responsible for services to children on any matter related to the interests and well-being of children
